The crime of assault is broken down by law in Missouri as follows:

FIRST-DEGREE ASSAULT

This is defined as trying to kill another or knowingly causing or trying to cause a person serious physical injury. It is charged as a Class B felony carrying a prison sentence of five up to 15 years.

SECOND-DEGREE ASSAULT

This has various definitions including the same one as first-degree assault when done in the heat of passion due to provocation. It also includes assault with a deadly weapon or reckless assault. It is charged as a Class D felony punishable by up to seven years in prison and/or a fine of up to $10,000.

THIRD-DEGREE ASSAULT

This involves knowingly causing physical harm to another. It is charged as a Class E felony punishable by up to four years in prison and/or a fine of up to $10,000.

FOURTH-DEGREE ASSAULT

This also has various definitions and scenarios including trying to cause and recklessly causing physical pain to another or putting the person in fear of imminent harm, acting in a way as to put another at risk of death or injury, or making physical contact that would be considered offensive by the alleged victim. It may be charged as a Class A or Class C misdemeanor , depending on the circumstances.

Class A misdemeanors are punishable by up to a year in jail and/or a fine of up to $2,000. Class C misdemeanors are punishable by up to 15 days in jail and/or a fine of up to $750.
